Filial ties stronger than Cupid's arrows?

VIJAY UPADHYAY
INDIA (AGRA), 1 JAN.
Love may be blind, but in the conservative society of India with its strong filial ties, when it comes to choosing between love and the family; most people still choose the family.

A similar incident that took place in Agra recently is boggling the minds of the Agra police which is helplessly watching the story unfold before its very eyes but is unable to decide on the course of action to be taken on the issue. A Hindu girl, who even adapted Islam to marry her beloved, is now being disowned by her lawfully wedded husband of four months despite being pregnant with his baby.

Still, when the police is ready to file sexual harassment charges against the husband, Deepmala, who has now changed her name to Farah after adapting Islam, is not willing to do so, claiming that if Danish, her husband wishes to re-marry, he is free to do so and she would continue to live with of without him as his second wife for the sake of her unborn child.

Talking to UNN, the Agra police’s women cell in-charge Kanchan Chowdhary said that Deepmala, a resident of Chhipitola area of Agra had fallen in love with Danish, a muslim youth of Nai Ki Mandi in Agra. After a brief affair, Danish proposed to marry Deepmala on the condition that she adapts Islam, which she readily did and changed her name to Farah. On 28 August this year, the two got married in the presence of a "Qazi" with Rs. 30,000 set as the "Mehar" though Danish did not take her to his home saying that her acceptance in his family would take some time.

But soon after the wedding, Danish’s mother Nafees Jahan, a teacher in a local school began to oppose the wedding and as accepted by Danish during interrogation, started threatening her son to choose between his wife and his mother. Apparently, Danish’s childhood memories prevailed and he sent off Deepmala alias Farah with a four month child in her womb, but apprehensive about the future of her unborn child, Deepmala refused to nullify their "Nikaah" saying that she is ready to live without her husband, but not without the name of her child’s father.

According to Ms. Chowdhary, she received the complaint of Danish’s mother that Deepmala had married her son under influence of some narcotic drugs administered to him in his unawares and in the circumstances, the Nikaah was not valid. Subsequently, she called both Danish and Deepmala to her office on Wednesday and asked them separately about their versions of the story and what she learnt from this interrogation was indeed shocking.

She said that both Danish and Deepmala seemed to be deeply in love with each other and it appeared that it was Danish’s mother who was playing the villainous role in the entire case. During the interrogation, Danish broke down in tears and accepted that he was indeed in love with "Farah" but he could not live with her as his mother had threatened him to commit suicide if he kept on living with Farah.

Similarly, Deepmala alias Farah also confessed her love with Danish saying that Danish was indeed under influence of liquor that he had consumed on the day they got married but she did not force this wedding upon Danish. She even accepted conversion to Islam out of her love for him but now, even when Danish disowns her, she would not stop calling him her husband for the sake of her child whom she’s still carrying in her womb.

According to Ms. Chowdhary, the love between this couple is so strong that when she asked if she wished to file a complaint against Danish for having harassed her sexually in the name of marriage, she bluntly refused to do so saying that she could live on with the memories of her time spent with Danish but the future of her unborn child is what matters the most to her and according to Islam, if a Nikaah is declared void, the child is called illegitimate and she could not tolerate her child to be called a "Najayaz" at any cost.

Helpless in this matter, the police has now submitted the report of the interrogation to the Senior Superintendent of Police Agra, Rajiv Krishna for further action, but the Islamic clerics are now challenging the legitimacy of the "Nikaah" consummated by a Qazi, who has simply disappeared from the face of the earth, asking the police to also call in the "Maulvi" who converted Deepmala, for interrogation to judge the real facts behind this story.
